Terms and conditions of Formelwerk Lerninstitut GbR, Salomon-Idler-Straße 14, 86159 Augsburg, Germany (hereinafter "Formelwerk"). The German version is the legally binding one; this translation is provided for convenience.
§ 1 Scope
These terms apply to all contracts for group courses, block courses and one-to-one lessons in mathematics and physics concluded between Formelwerk and the customer. Differing terms of the customer do not become part of the contract unless Formelwerk agrees to them in writing.
§ 2 Conclusion of contract
The presentation of courses on this website is not a binding offer but an invitation to make an enquiry. Submitting the enquiry form does not create a contract. A contract is concluded only when Formelwerk expressly confirms a place in text form; an email is sufficient.
Where the learner is a minor, the contract is concluded with the parent or guardian, who is the contracting party and the debtor of the fee.
§ 3 Free diagnostic test and first appointment
The diagnostic test on this website and the roughly thirty-minute appointment that follows it are free of charge and create no obligation to enter into a course contract. The result of the diagnostic test is a basis for conversation, not an assessment of performance.
§ 4 Scope of services
Formelwerk provides teaching in mathematics and physics in the course format, duration and group size stated in the booking confirmation. Lessons take place on Formelwerk's premises in Augsburg.
Formelwerk owes competent and careful teaching, but not a particular learning outcome. In particular, no specific grade, progression or examination result is owed or promised.
Formelwerk may replace an announced tutor with another equally qualified tutor.
§ 5 Fees and payment
The prices stated on this website or in the booking confirmation apply. All prices include statutory VAT.
The fee for the monthly group course is payable in advance by the third working day of each month. Fees for block courses are payable in full before the course begins. Individual sessions are payable immediately after the session or in advance as a block of ten. Payment is made by bank transfer or SEPA direct debit mandate.
In the event of late payment, Formelwerk may suspend its services until the outstanding amount has been settled. The statutory provisions on default remain unaffected.
§ 6 Cancelling and moving individual sessions
Individual sessions can be moved free of charge up to 24 hours before the agreed start. Later cancellation or non-attendance is charged in full.
If a session is cancelled for reasons attributable to Formelwerk, a replacement session is offered. If no replacement can be arranged, the proportionate amount is refunded.
For organisational reasons, missed sessions within group and block courses cannot be made up individually or refunded. On request we will provide the tasks covered in the missed session.
§ 7 Term and termination
The monthly group course is concluded for one school term. Either party may terminate it in text form with four weeks' notice to the end of a calendar month. Without notice it ends at the end of the school term and does not renew automatically.
Block courses are booked for their full length; ordinary termination during the course is excluded. On withdrawal up to fourteen days before the start, the fee is refunded in full; after that and up to the start, half the fee is refunded.
The right of both parties to terminate for good cause remains unaffected.
§ 8 Right of withdrawal for consumers
Contracts cannot be concluded through this website; the form transmits a non-binding enquiry only. If, exceptionally, a contract is concluded exclusively by means of distance communication — by email, for instance — consumers have a right of withdrawal of fourteen days from conclusion of the contract under §§ 312g, 355 of the German Civil Code.
Withdrawal may be declared informally to Formelwerk Lerninstitut GbR, Salomon-Idler-Straße 14, 86159 Augsburg, Germany, email kontakt@formelwerk.bizbrew.app. If teaching begins at the customer's express request before the withdrawal period has expired, proportionate compensation is payable for the hours delivered up to withdrawal.
§ 9 Customer obligations
Customers are responsible for punctual attendance and for bringing the necessary materials. Where the learner is a minor, the parent or guardian is responsible for the journey to and from lessons.
Formelwerk may exclude a learner from further lessons if they repeatedly and substantially disrupt teaching. In that case fees for services already provided are not refunded.
§ 10 Liability
Formelwerk is liable without limitation for damage arising from injury to life, body or health and for intent and gross negligence. In the case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract. Liability is otherwise excluded. The provisions of the German Product Liability Act remain unaffected.
§ 11 Copyright in teaching material
Worksheets, summaries and problem sets produced by Formelwerk are protected by copyright. They may be used for the learner's own study but may not be reproduced, published or passed on.
§ 12 Data protection
The processing of personal data is governed by our privacy policy, which is available on this website.
§ 13 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.
If any provision of these terms is invalid, the validity of the remaining provisions is unaffected. Amendments and additions require text form.
